dc.description.abstract In the present work, the thought of Manuel Atienza is approached based on its main discrepancies, despite its essential coincidence, with discursive postpositivism, a theoretical model shared by authors such as Carlos Nino and Robert Alexy. In this way, some conclusions are obtained about the postpositivist thought of the Spanish author.
